Tactical-forensic support of the verification of statements and reports on the stage of criminal case initiation

He main result of the study is the classification of initial situations presented by the authors, which is based on the criterion for obtaining evidence at the stage of criminal proceedings. The first group includes crimes for which, in order to identify the grounds for initiating a criminal case, preliminary verification of information on the possible commission of a crime is necessary. The second group includes crimes for which, at the time of the initiation of the criminal case, a sufficient amount of evidence was already collected that confirms the person’s involvement in the crime committed or in the commission of several crimes. The third group includes crimes, where the reason for initiating a criminal case is the statement of the person, in the criminal law sense - the victim. The authors concluded that in cases where the reason for initiating a criminal case is a statement by a person that a crime has been committed against him, the stage of initiating a criminal case should be truncated, i. e. the criminal case is opened without preliminary verification and the information provided by the victim is checked already at the stage of the preliminary investigation. In cases where a preliminary check is necessary to initiate a criminal case it is enough for an official of a law enforcement agency to establish with a sufficient degree of probability only the fact (object) of the crime committed.
