Article is devoted to a subject urgent today - mortgage lending. Wide use of the credit is a necessary condition of normal functioning of economy of any state. But crediting is impossible without serious ensuring interests of the creditor. Evolution of development of crediting has shown that most effectively interests of the creditor can be protected by means of use of pledge of the real estate. One of instruments of protection of interests of creditors by means of use of pledge of the real estate was the mortgage.
