Theoretical and legal characteristics of alimony obligations: foundations and conditions

In terms of studying scientific points of view, analyzing norms of the current legislation, as well as draft regulations, legal foundations of alimony obligations and necessary conditions for their establishment are considered. In the modern family law of the Russian Federation, alimony is understood as material resources provided by law for the maintenance of some subjects of law by others due to kindred, marital and other family legal relations that have developed between them. Alimony obligations are special obligations; they arise on the basis of imperative norms of family law, characterized by a complex subject composition and a publicity element. The main obligations arise between parents and children, spouses and former spouses, subsidiary obligations arise with the participation of other family members. The list of persons eligible for recovery of alimony, including compulsory, is established by the Family Code of the Russian Federation, and the possibility of recovery of alimony is determined by certain circumstances, which apply to both alimony payers and recipients.
