The interpretation and application of the rules concerning disposition of community property in the rulings of the supreme court of the Russian Federation

Purpose: Description of some of the topical legal rulings of the Supreme Court of the Russian Federation concerning the interpretation and application of rules that govern the disposition of community property. Methodology: The formal legal method was used. Results: The author considers some of the important issues relating to interpretation and application of the rules concerning disposition of community property contained in Article 35 of the Family Code of the Russian Federation. Special attention is given to the existing rulings of the Supreme Court of the Russian Federation and the criticism of such rulings. The questions regarding the competition of one of the former spouses’ interests on one hand, and the good faith acquirer’s interests on the other, are examined. Novelty/originality/value: The author thoroughly describes the stated rulings and the criticism of these rulings. Special attention is given to the shortcomings of current law.
