Transaction costs: modern methodological approaches in studying legal reality

Introduction: the usage of the economic theory for the analysis of legal relations allows to study an attribution a subject of law with rights, obligations and freedoms as a contract or transaction. The transaction costs are the resources which must be used for such transaction. Materials and Methods: as a methodology the methods of institutional economics and law and economics, as well as general theory of state and law were used. The materials are Russian and foreign research in the sphere of transaction costs. Results: the existing classifications of transaction costs in economics and law are studied, their applicability to civil law only is identified as their main drawback. The new classification of transaction costs applicable to public and procedural spheres is offered.
