Transboundary aspects protection of intellectual property rights in conditions of globalization

This article analyzes the legal problems of territoriality of intellectual property rights. The author shows the inconsistency of the autonomous nature of the national legal systems, protection of these rights in the contemporary context of globalization and the conditional expression «international protection of intellectual property»; describes the conflict and jurisdictional rules that apply to intellectual property with a foreign element. In specific examples the author shows what the main points should be considered right holders and users in cross-border use of intellectual property rights. As a result, the study of international and national sources of legal regulation, in particular the provisions of Part IV of the Civil Code of Russia, the author concludes that modification of the principle of territoriality in the modern context of globalization.
