The requirement about application of consequences of invalidity of a void transaction as the way of protection of property rights of individuals not participating in enforcement proceedings

The article analyzes the situation when the property rights of individuals not participating are affected in the course of enforcement proceedings. Materials of arbitration practices are investigated and various approaches to conflict resolutions, arising in this situation are considered, typical judicial errors and those of petitioners are outlined when settling similar disputes. Specific proposals concerning this category of affairs on the basis of synthesis of the corresponding practice are made.
