The author addresses issues relating to lawyers investigation in criminal proceedings. Logical continuation of the privateness in the criminal process is the expansion of the rights of the defense by picking up evidence in criminal proceedings, which are necessary to refute the suspicions and accusations, protection of individual rights. The only way to balance the status of subjects of the prosecution and the status of the subjects of the defense in criminal proceedings.
