Criminal and criminalistic procuring of suicidology

The article discusses the issues of qualification of crimes under Art. 110, art. 110.1 and Article 110.2 of the Russian Federation Criminal Code, as well as the forensic characteristics of criminal suicide. The aim of the study is to provide theoretical assistance to practitioners in the disclosure and investigation of crimes of this type. The organization of interaction between law enforcement officials and medical services of the health care system is of particular interest. The materials for the study were codified normative legal acts containing the norms of criminal law and establishing criminal liability for driving to suicide; texts of court decisions (sentences and rulings of courts of general jurisdiction of the Russian Federation) in criminal cases related to incitement to suicide and inducement to commit suicide, issued between 2015 and 2021; statistical data on the number of committed cases of criminal suicide on the territory of the Russian Federation; positions of legal scholars and criminologists, dedicated to the qualification and investigation of criminal suicide. Historical, comparative legal, analytical and statistical methods were used as the main research methods, which made it possible to obtain the following results. Results. In 72% of cases, suicide was committed by victims at home. The victims driven to suicide were women (74% of the cases studied) between the ages of 25 and 50. 49% of the victims at the time of committing criminal suicide were not married, were sober and had no suicidal tendencies before (90% of the victims). The crimes of the studied type in 84% of cases were committed by males aged 20 to 55. 58% of the subjects of the crime were married or lived in a civil marriage, about 87% were not registered with a psychiatrist or narcologist, more than 60% had children. 57% of crimes were committed out of hatred (personal hostility). Among the reasons for criminal suicides there were systematic humiliation of human dignity (42.39%), cruel treatment (38.05%), threats (13%), persuasion and admonition (3%), involvement in suicidal games (2%). In conclusion, the authors propose an algorithm for selecting objects that should be provided to an expert, as well as a formulation of the subject of a forensic psychological and psychiatric examination. As a proposal, the need to adjust the norms of Art. 110, art. 110.1 and Art. 110.2 of the Criminal Code, eliminating the ambiguous wording of the corpus delicti for the correct qualification of the act
