Criminal law mechanisms to counteract crimes perpetrated using artificial intelligence

The article examines both theoretical and practical aspects of the application of criminal law in relation to the use of modern technologies, such as artificial intelligence (AI), in the commission of criminal acts. The main trends in crimes committed with the use of AI are identified, and examples from emerging judicial practice are provided. Some criminal law measures to counter such crimes are suggested, including classifying technologies of deadly autonomous systems as weapons of mass destruction and placing their use against civilians and civilian objects under a criminal prohibition within a specific section of the Criminal Code of the Russian Federation, relating to crimes against peace and security. It is also proposed to impose criminal liability on legal entities represented by banks in case of fraudulent actions committed by third parties while debiting funds from electronic payment systems. The possibility of using AI technology to commit a crime is being considered as a qualifying factor for criminal liability.
