Criminal legislation in modern Russia: problems of systematisation and effectiveness

The article deals with the questions connected with the systematisation of modern Russian criminal legislation, structural elements that make up its content, system-forming factors and systemic connections between them. The issues of the criminal law effectiveness are also analysed and they are related both to the quality of criminal law norms and to the result of their action, which today is a real scientific problem that causes active debates among legal scholars and practicing lawyers. Based on the research, the conditions for the criminal legislation effectiveness are formulated and it is proposed to supplement its system with a new system-structural element, which is the institution of a criminal offense that in general is aimed at differentiation and individualisation of criminal responsibility and punishment.
