The work is dedicated to analysis of the last amendments in the private bankruptcy legislation. The author considers the possibility of abuse of the legal private bankruptcy mechanism and damaging to property of the debtor’s creditor, in terms of the correlation between a civil law abuse and the presence of an intentional crime.
