Discretion as a subsystem of elements of the mechanism of criminal procedural regulation

The article attempts to consider the criminal procedural category of “discretion” as an integral part of one of the elements of the mechanism of criminal procedural regulation. The author analyzes approaches to defining the mechanism of criminal procedural regulation, identifies its constituent elements and determines the place of discretion in it. As a result, he concludes that discretion, expressed in the presence of various discrete powers of the participants in the process, is an integral part of law enforcement, ensuring the adoption of the most effective procedural decisions that are adequate to the situation they made.
