Assignment of claims, novation and other alternatives court dispute resolution, relating to debt collection

The article examines issues related to the collection of receivables, including for goods delivered and work performed. Based on the current practice, taking into account the long and not always an efficient process refund through the courts, the author suggests alternative ways to tackle the conflict between creditors and debtors in pre-trial order. In particular, it examines the most common options for repayment of arrears, including the use assignment of claims, set-off agreement, accord and satisfaction agreement, and novation.
