Continuing the discussion on the place of criminal case initiation stage in the Russian criminal procedure

For many decades, the question has been discussed in legal literature on the legal nature of the criminal case initiation stage, on its preservation or abolition in the criminal procedure of the Russian Federation. This article substantiates the conclusion about the preservation of the stage in the criminal process as an independent, separate phase, the beginning of public criminal prosecution on behalf of the state in connection with the committed criminal act. The act of a criminal case initiation creates the conditions for performing compulsory procedural actions and ensuring the right to protection of the person against whom the accusatory activity is carried out. The stage of initiation of a criminal case is the basis for further effective administration of justice in a specific criminal case. The author positively assessed the legal regulation of the stage. The necessity and ways of cardinal improvement of law enforcement practice carried out by law enforcement officials within the boundaries of the stage are shown.
