Property contract as an alternative basis for changing the legal regime of the spouses‘ property

The authors consider the problem of transforming the common joint property of spouses into shared property in the absence of a marriage contract. Arguments are given in favor of the possibility of spouses, in the absence of a marriage contract, to include a condition on changing the legal regime of property in contracts concluded for the purpose of acquiring property in property, as well as to conclude an independent agreement of a proprietary nature. They conclude that it is necessary to change the provisions of civil and family law, in particular, supplement them with a list of property agreements that provide for a change in the legal regime of the spouses’ property.
