Victimological aspects of iatrogenic crimes

The article is devoted to the victimological aspects of iatrogenic crime: the factors determining the victimhood, victimological analysis, the problems of protecting the rights and legitimate interests of victims in cases of iatrogenic crimes. The author notes that for the crimes of this category, with the fundamental role of the doctor, the patient is also able to either reduce the risk of adverse consequences, or prevent it altogether. Therefore, the need to take into account the victim behavior of the patient when deciding whether to prosecute medical professionals for iatrogenic crimes is pointed out. Among the factors contributing to the onset of an adverse outcome, which depend on the patient, can include failure to comply with doctor’s orders, established diet, physical activity, untimely recourse to qualified medical care, self-medication, failure to inform the doctor of all information about the state of health and previously used treatments, used medications. In analyzing the issues of evaluating the quality of medical care, the author emphasizes the importance of the adoption by the Russian government of the Decree “On Approval of the Regulation of the independent medical examination”.
