Issues of individualization of measures of a criminal law nature, taking into account the personality of the perpetrator of the crime

The article examines the provisions of the Criminal Code of the Russian Federation in the context of the individualization of punishment and other measures of a criminal law nature. Significant potential is shown in deepening their differentiation and individualization, taking into account the personality of the perpetrator. It is noted that the main social measure of the personality of the perpetrator in criminal law is the crime, in which, as a rule, its antisocial orientation is expressed, and at the same time, it is important to take into account the individual characteristics of the personality of the perpetrator, which can be reflected both in the crime and outside it. The limits and criteria for the individualization of punishment for certain forms of crimes and certain categories of perpetrators are revealed. The issues of improvement of some normative provisions are discussed.
