Questions withdrawal of land plots for state or municipal needs. Part I

Authors examine the regulation, as well as the procedure of seizure of land plots for State or Municipal needs in Russia. The analysis performed of compliance of the legislation of the Russian Federation within world-wide practice, which includes the principles and requirements of compulsory acquisition provided by the Food and Agriculture Organization (FAO). Authors suggest options for resolution of identified conflicts. Main attention paid to the need of improving methods of determining the redemption value of the seized land plots by distinguishing the date of determination of type of use of land plot from the date of its physical condition and date of valuation.
