Relationships between law and morality in Herbert Hart's scientific work

The paper is dedicated to the founder of analytical jurisprudence H. Hart, who entering into a correspondence debate with H. Kelsen, sought to substantiate the empirical nature of normative facts, which he brought from the sphere of pure legal reason to the sphere of empirically given reality. Justifying the possibility of scientific knowledge of the “sphere of normative facts”, H. Hart established a distinction between primary and secondary moral and legal rules. According to H. Hart, law must comply with morality, but this correspondence is not simple and straightforward, just as it seemed in the classical theory of natural law.
