The upbringing of children by same-sex spouses: issues of theory and practice

The article considers the approach of the Russian and foreign legislator to the formation of the normative base allowing to foster and adopt children by same-sex couples. The gaps in the Russian legislation have been indentified. The judicial precedents of the USA and the European Court of Human Rights concerning the rights to bring up children by same-sex domestic partners have been analyzed. The possibility of reception of the foreign experience by the Russian legislator has been estimated.
