Obstructing medical assistance: latency and victimity factors

Introduction: the author studies obstructing medical assistance through such criminological aspects as latency and victimization. Such a study appears necessary for identifying potential causes of absence the absence of investigative and judicial practice of criminal liability for this unlawful act in the Russian Federation. Materials and Methods: the research materials were based on theories on latency and victimization, developed by criminological science, modern criminal legislation of Russia, official data of the Judicial Department under the Supreme Court of the Russian Federation on liability for obstruction of medical assistance for the period 2019 - 2022, as well as data from a sociological survey. The methodological basis of the study is the dialectical method of cognition, analysis, logical and statistical methods, as well as the method of expert examination in the form of formalized questionnaires of medical workers. Results: the obstruction of medical assistance has been investigated from the point of view of its victimization and latency factors, argued the likelihood of high latency of the act in question. Discussion and Conclusions: based on the analysis of criminological aspects, analysis of responses to survey of healthcare workers the author presents measures to prevent obstructing medical assistance.
