Compensation and reparation of criminal harm in another way as an element of the model of encouraged behavior

Introduction: in the article, on the basis of the analysis of modern criminal legislation, the resolution of the Plenum of the Supreme Court of the Russian Federation of June 27, 2013 № 19 "On the application by the courts of the legislation regulating the grounds and procedure for exemption from criminal liability”, application the norms on exemption from criminal liability, legal literature the author considers models of encouraged behavior of a guilty, aimed at mitigation the consequences of the committed act, identifies discrepancies in understanding the contents of this model in the text of the Criminal Code and the mentioned resolution of the Plenum of the Supreme Court; suggests to document traditional ways of reparation of criminal harm in another way as a note to to Part 1 of Article 75 of the Criminal Code of the Russian Federation.
