Occurrence and formation of the mining right of Spain

The article gives a brief description of the ancient sources of mountain law in Spain. The features of the first decrees of the kings of Spain are indicated: the right of the monarch to land and minerals, free search for minerals and their development with the payment of royalties to the king, licensing by the discoverer of mountain areas with minerals, legislative establishment of the scale of royalties-the percentage of payment of extracted and enriched precious metals and other mineral raw materials to the state Treasury, etc. The decree of king Philip II of Spain, proclaimed on 22 August 1584 in San Lorenzo, became the main source of mountain law of the Spanish colonies and then of the States of the New world (America).
