Harm as a criminogenic factor in the corpus delicti under part 2 and 3 of article 274.1 of the Criminal Code of the Russian Federation (hereinafter referred to as CC of the RF)

In the science and judicial practice the determination of the criminogenic factor of “harm” in parts 2 and 3 of article 274.1 of the Criminal Code of the Russian Federation (hereinafter referred to as CC of the RF) causes difficulties. Having analysed the literature and criminal cases regarding prosecutions of persons for illegal influence on critical information infrastructure of the Russian Federation (hereinafter - CII of the RF), the author concludes that the harm caused to CII of the RF should be understood as any adverse changes in the legally protected critical information infrastructure of the Russian Federation, which may be expressed both in tangible and intangible terms, culpably caused by illegal influence of the subject and causally related to it.
