Choosing of intellectual property protecting forms in process of innovation activities

The paper analyzes the main factors and conditions of rational choice of intellectual property protecting forms. The criterions of choice of intellectual property protecting forms are worked out. On this base it was made a comparative analysis of the three main intellectual property protecting forms and use in commercial innovation activities: patenting, commercial secrets, defending publication. The analysis was made according to the requirements of effective protecting and use of intellectual property in innovation activities. The choosing peculiarities of the two protecting forms: patent and commercial secrets were analyzed. It was pointed down that for choosing he appropriate protecting form it is necessary to analyze the technical exclusiveness of the novelty, market conditions and technical and financial opportunities of the enterprise. The comparative analysis of the effectiveness of intellectual property protecting by patenting and commercial secrets was made. It was revealed that patenting is more secure than protecting as commercial secrets because commercial secrets are protected as confidential information from illegal access, use and disclosure. When technical novelty obtains high commercial value and exclusive rights give wide opportunities for the owner patenting becomes the best intellectual property protecting form. The loss risks and risks of intellectual property infringement were revealed. A special role of defending publication was analyzed. Defending publication is a special intellectual property protecting form. It is made by the inventor in order to spread the information about technical novelty without intention of patenting. So the technical novelty comes into public domain. Defending publication is very useful for providing security in scientific and technical progress for several sectors of economy (especially for the information and communication technology sector). The conclusion was made that the correct use of all intellectual property protecting forms (patents, commercial secrets and defending publication) makes it possible to take into account all peculiarities of innovation business projects of enterprises and that is why fulfill innovation activities on appropriate base.
