The article deals with the essence and interaction of social norms (law, morals) and judicial precedent as the basic tools of the administration of justice. The authors try to establish a criterion for distinguishing between legal and moral dominants within the framework of undifferentiated, syncretic behavioral norms that took place at the early stages of the development of society. The article supports the opinion of pre-revolutionary jurists on the understanding of the legal norm as a legal conviction, which, the authors highly appreciate the activity of the judicial system in the formation of behavior norms, not established by the legislator, through the instrument of judicial precedent.
