Legislative specifics of the public domain legal regime in Russian civil law as seen through the court practice of the Russian Federation Constitutional Court and the European Court of Human Rights

The article is devoted to the legislative specificity of the legal regime of public property in the Russian Federation and to the analysis of the legal position of the Constitutional court and of the Human Rights Court of Europe. The author proves that establishing lawful particularities of legal status of public subjects and regime of government property with particular purposes in case of following rights and legitimate interests of counteracting parties of the State and other public entities does not contravene the Constitution of the Russian Federation and corresponds to legal proposition of the Constitutional Court of the Russian Federation and the Human Rights Court of Europe. The article concludes that there is relevance of applicable law establishing in some cases non-extension of the limitation period for certain demands of the State toward the counteracting parties of the State, to constitutional practice of legal positions of the Human Rights Court of Europe and the national civil theory.
