Construction works procurement in the contract system with the life cycle contract: competition insurance and performance responsibility

The paper deals with topical issues related to the procurement of construction works using a life cycle contract (LCC). The purpose of research is to study law enforcement practice and develop recommendations for customers who procure construction works using the LCC as efficiently as possible and with an increase in the number of participants. Research methods - comparison, analysis, method of expert assessments. The contract system in the field of procurement is based, on the one hand, on the principle of competition ensurance (creating equal conditions for procurement participants), and on the other hand, on responsibility for the effectiveness of meeting state and municipal needs, the efficiency of procurement, which provides maximum satisfaction of customer needs within the framework of compliance with the law. Procurement of construction works using the LCC has the peculiarities of ensuring the named principles of the contract system. The relevance of this area of research is determined by the importance of using the LCC to accelerate the processes of reproduction of capital construction projects. The scientific novelty of the work lies in the analysis of trends in the LCC law enforcement practice in the procurement of construction works in the context of changes in legislation in 2021-2022.
