Bail as a condition to exempt from criminal liability with the establishment of pledgery

In this article, the author analyzes the provisions of the new Criminal Code of Kazakhstan regulating the exemption from criminal liability with the establishment of pledgery. In particular, the author reviews the issues of defining requirements to the pledger, the lack of conditions of the victim's consent to exempt the accused from criminal liability with the establishment of pledgery. In addition, the author considers the problems of procedural implementation of explaining consequences of bailment and its fate in case if the person commits a new criminal offense under the regulation of the exemption from criminal liability with the establishment of pledgery. The author provides her own arguments to eliminate ambiguities and contradictions of the Kazakhstan legislation in the matter under inquiry.
