The article addresses issues related to the concept of protection of the right to privacy; The features of the collection and research of materials that characterize the identity of parties to the criminal conflict, as well as the identity of witnesses, have been studied; The impact of the personality data obtained on procedural decision-making. Sharing the opinion of psychiatrists on the need to carry out forensic psychiatric examinations of accused persons for intentional crimes, the view is defended that it is unacceptable to study data on the mental and medical condition of the person in open court. Given the modern way of life, the change of moral and moral criteria, the proposal to exclude personal characteristics in assessing the behavior of a person in specific conditions is justified, otherwise there may be an investigative error, the result of which will be a judicial error.
