The abuse of right (chicane) and the roman law

The article studies the theory of abusing of rights. The author comes to the conclusion, that the Roman legislators denied the very possibility of abusing of right (chicane), and the opinion that the Roman law forbade the chicane and envisaged certain negative consequences for a person committing it is based only on suppositions of academic lawyers of different generations not confirmed by indisputable documentary sources. According to the Roman law, an owner does not have any limitations of the authority over a thing, except for the laws in the interests of the owners’ community.
