Implication of the “non bis in idem” principle for delimitation between crimes and administrative offenses under the Ukrainian legislation

The article is concerned with influence of the criminal law principle «non bis in idem» on the possibility of bringing to both criminal and administrative liability for the same offence. Basing upon the study of the Ukrainian current legislation the article adduces arguments regarding impossibility to be responsible for the same offence both under administrative and criminal law. The author introduces criteria, following which one can distinguish the criminal and administrative offences in case they are phrased identically in the laws.
