Zone of Legal Uncertainty: Problems of Implementing Paragraph 7 of Article 14 of the Federal Law "On Operational Search Activities" and Finding a Balance between Security and Freedom

This article is devoted to a comprehensive study of the legal and practical uncer-tainties arising from the implementation of paragraph 7 of Article 14 of the Federal Law “On Operational Search Activities” (hereinafter referred to as the Federal Law “On Operational Search Activities”). The article provides a multifaceted analysis of the issue, examining its constitutional and international legal implications, identi-fying practical risks for all involved actors (citizens, law enforcement agencies, the National Guard, and the judiciary), exploring doctrinal approaches to the nature of such restrictions, and suggesting possible legislative solutions aimed at restoring the balance between security interests and the inviolability of individual rights.
