Administrative responsibility and the application of a risk-based approach when organizing state control (supervision) over the areas of economic activity of economic entities

The Article is devoted to the actual problems of implementation of the risk-based approach in the system of state control and supervision during scheduled inspections in the activities of economic entities. The expansion of the scope of application of this approach has led to a variety of departmental regulatory legal acts, the content of which is characterized by the lack of uniform rules for all state control and supervision bodies to change the established categories of risks in relation to such a criterion as the systematic Commission of administrative offenses in the established field of activity. As a result of the study of the above-mentioned problematic aspects, possible options for their resolution and directions for improving the legislation of the Russian Federation regulating the use of the risk-based approach of the state in the implementation of scheduled inspections and assignment of risk categories in the Commission of administrative offenses are proposed.
