The article analyzes the issues of regulatory justification and practical implementation of the possibility of bringing parents or other legal representatives to administrative responsibility provided for in Part 1 of Art. 5.35 of the Code of Administrative Offences of the Russian Federation in cases related to the parental permissiveness or non-compliance of the parents with the requirements of the law in the field of road safety. The authors come to the conclusion that such acts should not be considered as a completed offense, but as a reason for conducting an appropriate inspection and possible initiation of an administrative offense case, provided that there is a factual basis. An algorithm is proposed for the actions of the traffic police officials in cases of identifying offenses in the field of road traffic resulting from non-fulfillment or improper fulfillment of parental duties.
