For a long time it was believed by the Soviet lawyers, lawmakers and common people that the state as if grants the rights to an individual. The adopted constitutions of the CIS countries have changed poles: the priority is given to the ensuring the constitutional laws and freedom of a person and a citizen over the interests of the state as a whole. So, the Constitution of the Republic Kazakhstan adopted on August, 30th, 1995 on the national referendum in the first article has defined that «the Republic Kazakhstan confirms itself a democratic, secular, legal and social state whose supreme values are a person, his life, the rights and freedoms» [1].
