Administrative and legal impact on economic relations

The article examines the social relations in the sphere of economy and finance as the object of administrative and legal measures. The rationale behind the author's position about the need for direct and indirect administrative and legal impact on social relations in this sphere. Such relationships, being primarily a subject of civil law, however, even in conditions of a market economy require managerial intervention of the state. However, if in the USSR such exposure was carried out within a strictly hierarchical system established by the Constitution of the USSR, in modern conditions the mechanism of state influence on the economy and finance has a non-hierarchical or partially hierarchical in nature (with the exception of public finance, regulated by the norms of financial law), which determines the necessity of using other legal means, one of which is indirect (mediated) administrative-legal relations. Also indicated on the shortcomings of the concept of entrepreneurial (economic) rights, which cannot be considered as a separate legal education (these social relations are regulated on the basis of methods of civil and administrative law), and may be used exclusively for scientific and educational purposes.
