Every year, society is becoming more and more aware of the need for the institute of transplantology for humanity, and replaces irrational criticism with a serious analysis of all the problems that arise in the process of transplantation of human organs and tissues. At the same time, it should be noted that the most important problem in the field under consideration continues to be the legal regulation of procedures for obtaining consent for the collection of donor organs. To this end, the author analyzed the problematic aspects of the institute of transplantation, which require improvement of legal regulation. The conducted research suggests that the study of transplantation in the context of legal regulation is extremely important because it affects not only the legal, but also the ethical side of this issue. As a result of the analysis of the legal foundations of this area, we can say with confidence that a number of separate aspects of transplantation do not have legal regulation, and some need to improve legal regulation. The position expressed by the author is indirectly confirmed by the serious successes of foreign transplantology, in which the legal regulation of the performed clinical transplants of organs and tissues is given great importance. The scientific novelty of the work is determined by the analysis of the legal aspects of transplantation that require improvement. The resulting conclusions can be used to improve the effectiveness of the legal regulation of domestic transplantology.
