Current issues on the subject of drug crimes: clarifications of the highest judicial instance

The article considers the practice of determining the signs of subject of drug crimes. The problematic issues of establishing its qualitative and quantitative characteristics are analyzed. The examples of applying specialist opinions (the results of chemical and toxicological researches) to identify the type of substance if it is impossible to carry out its chemical examination are given. The rules for establishing the amount of a narcotic drug mixed with a neutral substance, as well as the amount of narcotic plants and their parts, are clarified. The approaches to determine the amount of a narcotic applied to a piece of paper («a mark») are suggested.
