Current issues of Russian criminal proceedings: investigation of crimes, appointment and execution of punishments

The article examines the current problems of Russian criminal justice in the context of the digital transformation of society. The relevance of the topic is argued by the presence of a clear gap between technological development and the current legal regulation of procedural activities, which creates significant difficulties in law enforcement practice. In the course of the study, using methods of comparison, systematization, generalization, significant contradictions between traditional mechanisms and modern requirements for the effectiveness of justice were revealed. In particular, there is a discrepancy between the formal approach to assessing the identity of the offender and the need for in-depth analysis of socio-psychological characteristics to determine the optimal punishment. A discrepancy has been found between the need for prompt investigation of acts and the limited possibilities of using modern developments in evidence. The author comes to the conclusion about the need for a comprehensive modernization of judicial proceedings based on modern innovations while maintaining fundamental principles. The importance of the institute of mediation, strengthening mechanisms for protecting the rights of victims, as well as the integration of scientifically based methods for assessing the identity of criminals is substantiated.
