Apartments as a kind of dwelling: directions and initiatives of legislation improvement

The article is devoted to identifying the legal preconditions that led to the problem of construction of apartments. There have been analyzed the main normative acts regulating the requirements to the design and construction of residential premises. It is revealed that the problem of construction of apartments is complex and has, among other things, administrative and tax aspects. The authors note that the actual problem is the development of the classification of the property, including the development of criteria for their classification to determine their fate. The interesting point is the protection of bona fide purchaser by the inclusion of apartments in the law “On participatory construction”. In conclusion, the authors observe that, undertaken at Federal and regional level measures indicate a positive direction in dealing with the problem of construction of residential premises under the apartment.
