The archetype "justice", the law of the dominant and the legal life

The relationship of the archetype of «justice» and legal life are analysed in this article. The author shows that the triad of «peace, justice and international law» stated in the UN Charter at the turn of XX-XXI centuries loses its absolute character, and the relation of «justice» to the right stops being unconditional. Then a brief history of law typology is presented. The author compares the enforcement dominants, which characterise the legal reality of different religious and philosophic systems and organically connected with the archetype «justice» The author highlights that the actualisation of this archetype in any of these realities necessarily linked to the idea of the retribution. According to the author, in the legal activities of the United Nations the «right of the dominant» prevails, which realises itself as the right of fair selective retribution. But the responsibility for the retaliation fulfillment «by default» is assigned to the legal sense of the legal entities. On the one hand, this shift of emphasis indicates a destructive metamorphosis of traditional sense of justice. On the other - strengthening the role of the legal feeling indicates the untapped potential of the legal life, which intuitively seeks to eliminate the destructive tendencies in the legal conflicts of modernity.
