Based on the analysis of court rulings, the article shows some problems of the practice of applying by courts the rules governing the use of audio recordings as a means of proving the lack of money of a loan agreement. The author focuses on the analysis of the arguments that guided the courts of various instances, making decisions on the admissibility or inadmissibility of audio recordings as an independent means of proof in the case of consideration of the arguments of the party about the lack of money of the loan agreement.
