Unemployment: legal positions of the Constitutional Court of the Russian Federation

The social risk of unemployment, which is in itself a basis of social security is not always perceived by citizens as it was intended by the legislator. Assuming that their rights have been violated, citizens often turn to the Constitutional Court of the Russian Federation, which shall express its position. Based on the conception of the legal positions of the Constitutional Court of the Russian Federation developed in the science as conclusions of a general nature acceptable and necessary for solving similar problems in the context of consideration of other applications to the Court, the author justifies the conclusion that they do not fundamentally change the vision of this social risk, but at the same time deepen her understanding, contribute to a more correct perception of the subjects of legal relations in this area. These positions reflect the current understanding of the balance of interests of the state and citizens, the role of citizens as the active subjects of social risk management system can, where necessary, undertake the necessary efforts to overcome it.
