The fight against corruption by weakening criminal repression cannot be successful

The article considers the legislator’s approaches to the development of criminal law means to counter corruption. The addition to the criminal law special norms providing for the liability for official misconduct is an effective but subtle enough tool for differentiating liability. The public danger of encroachment, provided for by the new rules, should be adequately evaluated, both by itself and in relation to the already established in the law assessment of the risk of related official misconduct. Violation of this rule by the legislator leads to the liberalization of liability for corruption crimes and further inconsistency in the criminal law.
