Transcendentalism of I. Kant and J.G. Fichte supposing to include the activity of the subject of cognition in the object of his reflection, determined the necessity of deducing law from the subject's activity on the basis of the idea of his freedom. Both classics solve this task in different ways: for Kant, a higher moral law mediates the transition from the subject's freedom to the norms of law, for Fichte this transition is direct, therefore he separates the law from morality and ethics from jurisprudence. Despite the difference in views, the works of these two thinkers of the past - I. Kant and J.G. Fichte - on the law and morals remain relevant today. This is the reason to study and analyze problems related to the relationship between law and morality, taking into account the achievements of modern national historical and legal studies.
