Дефекты в корпоративном законодательстве как фактор виктимизации учредителей корпорации

В статье автор исследует влияние недостатков в корпоративном законодательстве на уровень виктимизации участников корпорации. Автор поднимает проблемы в рамках анализа дел по корпоративным спорам. Отдельное внимание уделяется противоречиям и пробелам в корпоративном законодательстве, что оказывает влияние на участников корпорации. Автор анализирует, как эти дефекты могут привести к виктимизации участников корпорации, раскрывает причины и последствия пробелов и противоречий в корпоративном законодательстве. Автор предлагает возможные решения для устранения этих дефектов и снижения уровня виктимизации. В статье поднимается вопрос о необходимости разработки понятия «корпоративного спора». Рассматривается его отличие от понятия «корпоративный конфликт».
