The article is about the work of A.F. Kistiakovsky, devoted to the death penalty. Focusing on the main ideas of the outstanding Russian criminologist, the author of the article finds them reflected in the modern scientific doctrine of criminal law. The positions of supporters of the abolition of the death penalty, as well as supporters of its preservation, are considered. The data from public opinion polls on the issue of maintaining the moratorium on the death penalty in the Russian Federation are presented. The conclusion is made about the humanization of criminal legislation towards the abolition of the death penalty.
