The deportation of Soviet Germans as one of the repressive aspects of the criminal policy of the Stalinist period

Purpose of the study is to study theoretical and practical retrospective and modern aspects of the criminal policy of the Russian state through the prism of critical analysis, development of new topical approaches to the formation of a policy of combating crime. Methods of content analysis, dialectical, system-structural, historical and comparative methods were used. Some aspects of the criminal policy of the «Stalinist» period, carried out in relation to the «Soviet» Germans, have been analyzed. It has been established that during this period the legal concept of «criminal policy» was replaced only by its political component. The repressive component of the criminal policy of the «Stalinist» period included such types of punishment that were absent in the Criminal Code of the RSFSR in 1926. In addition, repression as deportation was applied to representatives of other peoples of the USSR. The scientific novelty of the work lies in the fact that the authors, on the basis of historical sources, studies of modern specialists, analyzed the criminal policy of the Russian state of the Soviet period, based on the use of such a repressive measure as deportation (resettlement, exile, expulsion), which taking into account all the louder currently sounding proposals to return the application of such (or a similar) measure of punishment, its consolidation in the Criminal Code of the Russian Federation, is relevant.
